GENERAL   REMARKS

(which shall be taken as forming part of the Conditions of Sale).

Each lot is sold subject to all tithes, land tax and other outgoings, rights of way, water, drainage or other easements, and to all existing tenancies, tenants' rights and incidents of tenure, whether mentioned in these Particulars or not.

Fixtures.—All fixtures which are the property of the Vendor are included in the sale of the respective lots, but all such fixtures as are not the property of the Vendor are excluded from the sale, whether mentioned in these Particulars or not.

Rentals.—In certain cases the lands now included in one tenancy have been divided between two or more lots. The Purchaser of each lot shall accept in respect of the portion included in the lot purchased by him the apportioned sum of rent stated in an apportionment statement, which has been prepared by the Auctioneers, which statement will be read, if required, at the sale, but the Vendor shall be under no liability to obtain the consent of the tenant thereto.

Tithes.—The amount of tithe stated in the Particulars of the various lots is the commuted value so far as can be ascertained and all the lots are sold subject to the pay­ment by the Purchaser of tithe rent charge in accordance with the said stated values until they shall have been duly apportioned by the proper authority, but the Vendor shall not be called upon to obtain any legal apportionment, nor shall any allowance or compensa­tion be made in respect of any inaccuracy or omission in the statement of tithe payable.

Rights of Way, Etc.—Where any right of way or right of taking water or drainage, or any other easement or quasi-easement has hitherto been enjoyed by any of the premises from, through or over any other premises forming part of the same estate, the same rights and liabilities shall, as nearly as may be, be vested in and borne by the Purchasers of the various lots as though such premises had always been the property of separate owners, and each Purchaser shall purchase subject to this condition. The Conveyance to each Purchaser shall, where necessary, and if required by the Vendor, be framed so as to give effect to this paragraph, and in case of any dispute the decision of the Vendor shall be final. All rights of way (if any) reserved in the Particulars to the owner for the time being of any lot, over tracks or roadways included in other lots, are subject to the condition that the owner for the time being of the dominant lot shall make good any damage he shall do by the user of such right to the said tracks or roadways of the servient lot, and shall also, where necessary, erect, and in all cases maintain good and sufficient gates in such hedges as cross the right of way, whether such gates exist at the time of the sale or not.

Tenant Right.—If at the time of the completion of the purchase any of the lands comprised in any lot are in hand, the Purchaser shall take to and pay for at a fair valuation, to be made in the usual way, in addition to his purchase money, all cultivations and acts of husbandry in respect thereof as between an outgoing and incoming tenant according to the custom of the country.

Cultivations.—The descriptions of the cultivations of the lands may be taken as representing their present state, but shall not affect the rights of the tenants to alter such cultivations and the properties are sold subject to such rights.

Water Supply.—The water supply to Lots 9, 44, the Green Bottoms Buildings on Lot 49, and the supplementary supply to Lot 1 are derived from a covered spring, situate in enclosure No. 88a, part of Lot 49, and Lots 1, 9, 44 and 49, are sold with the right to the continuance of such supply as heretofore enjoyed, and the owners for the time being of such lots shall maintain in good repair the pipes conveying such water so far as they are situated on their respective lots, except as mentioned in the Particulars of Lot 9. The covered chamber at the source of supply shall be maintained at the joint expense of the owners for the time being of Lots 1, 9, 44 and 49.

The Track or Roadway, No. 373 on Plan, is believed to be a private road belonging to the Estate, and shall be maintained for their own use, and at their joint expense, by the owners for the time being of Lots 1, 8 and 13.

Timber.—The timber standing on Lots 2, 3, 6, 7, 13, 42 and 46, has been moderately valued by the Auctioneers at the sums stated in the Particulars of the respec­tive lots, and Purchasers of those lots shall pay for the timber in addition to their purchase-moneys at the figures mentioned. Part of the timber on Lots 12b, 23, 24 and 45, and the whole of the timber on Lots 11 and 12a is being excluded from the sale of those lots and offered separately as set forth in the Particulars, and the sums stated as the value of the timber on Lots 24 and 45 comprise only the remainder of the timber which will have to be paid for by Purchasers of these lots, in addition to their purchase-money. In all other cases the timber (if any) will be included in the sale of the respective lots. The detailed quantities of the timber given in the Particulars of Lots 8, 12c, 24a, and 45a have been carefully estimated by the Auctioneers' Valuer, but are given for the conveni­ence of Purchasers only, and their accuracy is not in any way guaranteed.

Minerals.—All mines, minerals, etc. (if any), underlying the Estate are included in the sales of the respective lots, with the exception of the mines, minerals, etc., under­lying the small portion of the Estate which is in the parish of Glusburn, and which are not the property of the Vendor, and are consequently excluded from the sale.

POSSESSION.—Where notice to quit at February 14th, 1924, has been served on the tenant Purchasers should note that by Section 29 of the Agriculture Act, 1920, no notice to quit in respect of any lot in these Particulars to be sold is in any way affected by a Contract for Sale being entered into and that all notices are valid.

The Vendor reserves the right to hold a Sale by Auction of the furniture, etc. in the house at any time prior to the completion of the purchase.
